New Regulatory Framework for Independent Surveillance in Nuclear and Radioactive Waste Facilities
The regulation expands the scope of the original 2024 regulation to include radioactive waste facilities alongside nuclear facilities. To ensure the independence of Independent Surveillance Organizations (ISOs), the provision linking service fees to surveillance outcomes is prohibited, unannounced inspections are authorized, and financial independence from the facility operator is mandated. Furthermore, surveillance processes are digitized with a compulsory non-compliance management system, while administrative requirements such as on-site project management and personnel competency standards are enhanced. A transition period is established until December 31, 2027, to ensure operational continuity.
Amended Legislation
Change:The regulation broadens its scope to include radioactive waste facilities and introduces comprehensive amendments regarding the operation of independent surveillance activities, inspection procedures, the independence of ISOs, technical infrastructure, and personnel competency requirements.

Judicial Review of 'Special Procedures' in VAT Refund Processes
The Tax Litigation Chambers of the Council of State has ruled that administrative actions placing taxpayers under 'special procedures' regarding VAT refund audits are subject to judicial review. The court determined that such actions significantly impact a taxpayer's commercial standing, reputation, and tax rights, and therefore qualify as 'definitive and enforceable administrative acts' challengeable in court. Consequently, the legality of these actions must be assessed on their merits by the relevant administrative courts.

Constitutional Court: Violation of the Right to a Reasoned Decision
In the individual application filed by Ramazan Çakır, it was alleged that the right to a reasoned decision was violated as the courts failed to address essential objections regarding ByLock usage and organizational ties during the criminal proceedings for terrorism membership. The Constitutional Court concluded that the domestic courts did not sufficiently respond to the applicant's specific objections regarding ByLock evidence in light of current precedents, thereby violating the right to a reasoned decision. The Court ordered a retrial.

Constitutional Court Rules Violation of Legality Principle in Terror Aiding Conviction
The application concerns the conviction of the applicant, a former association treasurer, for 'knowingly and willingly aiding a terrorist organization' based on his role in the association's aid collection and transportation activities and a music file found on his phone. The Constitutional Court ruled that the lower courts failed to provide sufficient grounds establishing that these acts constituted the specified crime and employed an unforeseeable, expansive interpretation of the law. Consequently, the Court found a violation of the principle of legality in crimes and punishments guaranteed under Article 38 of the Constitution.

Constitutional Court Rules Property Rights Violation in De Facto Expropriation Case
The applicants filed an individual application to the Constitutional Court after their compensation lawsuit regarding the de facto expropriation of their property without due compensation was rejected. The Court found that the administration failed to provide valid evidence of consent from previous owners for the transmission line installation and did not conduct a proper expropriation procedure. Consequently, the Court ruled that the lack of procedural safeguards in the judicial process resulted in a violation of the right to property, ordered a retrial, and mandated the payment of legal costs to the applicants.
