Failure to Update University Diploma After Name Change Constitutes Violation
The applicant, who legally changed their name and gender, filed an individual application to the Constitutional Court after the university refused to reissue their diploma with updated information. The Court ruled that maintaining the diploma with previous details, despite official legal changes, constitutes a violation of the right to respect for private life. It was determined that administrative and judicial authorities failed to balance the applicant's interests with public interests, and that the refusal based on rigid regulations did not meet the requirements of a democratic society. The Court ordered a retrial to remedy the consequences of the violation.

Constitutional Court Upholds Disciplinary Penalty for Asset Declaration Non-Compliance
The Constitutional Court rejected the request to annul the provision in the Law Decree No. 7068, which stipulates disciplinary penalties for law enforcement personnel failing to submit mandatory asset declarations. The Court ruled that the disciplinary measure complies with the principle of legality, serves the public interest in maintaining efficient service, and is proportional. Furthermore, the Court determined that the disciplinary sanction does not possess the character of a criminal penalty, thereby concluding that the 'ne bis in idem' principle is not violated.

Annulment of Security Exemption in De Facto Expropriation Lawsuits
The Constitutional Court has annulled the second paragraph of the additional article 4 of the Expropriation Law No. 2942. The annulled provision exempted the administration from the requirement to provide security when requesting a stay of execution in compensation cases arising from de facto expropriation without legal process. The Court ruled that this regulation violated the right to property and constitutional guarantees, as allowing the administration to stay execution without security imposes a disproportionate burden on rights holders by delaying their compensation.
